1. INTRODUCTION
1.1. What is our role
Josip Konta Art d.o.o. is the exclusive representative of the artist, academic sculptor and painter Josip Konta (hereinafter: Artist).
The company Josip Konta Art d.o.o., Croatia, Zagreb, Radnicka cesta 80 (hereinafter: Josip Konta Art d.o.o.) performs the service of selling copyright artworks of Josip Konta (hereinafter: Artworks) by delivering the ordered Artworks without storage directly from the Artist to the Customer. The supplier of the purchased Artworks is Josip Konta Art d.o.o. from Zagreb in the name and on behalf of the Artist.
1.2. Types of artworks
The Artworks in our offer can be sculptures, oils on canvas, graphics, and pastel drawings. In the text, the term Artwork includes all types of art that may be in our offer - sculptures, oils on canvas, graphics, or pastel drawings, unless otherwise indicated, in which case the text will write Artwork type of sculpture, Artwork type oil on canvas, Artwork type graphics or Artwork type pastel drawing.
The sculptures in our offer are usually made in patinated bronze, unless otherwise indicated. Oils on canvas and pastel drawings on offer can be framed or frameless, or as will be indicated in the descriptive text.
1.3. Editions
All sculptures by Josip Konta, modeled in plaster, are handmade unique sculptures. Unique sculptures are not intended for sale. Josip Konta’s sculptures made of patinated bronze can only be original copies, made up to eight original copies (editions 1/1 - 1/8) intended for sale, and up to four author's copies (editions EA I/IV - IV/IV) which they are not commercial, i.e. they are not intended for sale.
Oils on canvas and pastel drawings are unique works of art. Graphics are made in limited editions.
1.4. The way our Internet store works

The activity of the Internet store https://josipkontaart.com/en/josip-konta-art-buy-online, which is part of the website www.josipkontaart.com, is to perform the service of selling Artwork in such a way that the Artwork is sold without storage, directly from the Artist, delivered to the Customer. The supplier of the sold Artworks is Josip Konta Art d.o.o. from Zagreb.
The website www.josipkontaart.com, to which the Internet store belongs https://josipkontaart.com/en/josip-konta-art-buy-online can be used for your private use without any fees for use, and according to the conditions stated here and rules. By using the www.josipkontaart.com Internet store, you agree to the Terms of Use stated here, and undertake to abide by them.
Josip Konta Art d.o.o. through the Internet store it enables the purchase of the range of Artworks on offer. The service consists of providing information services and content management, promotion, sales, billing and organizing delivery with external associates.
1.5. How to become a customer
The Customer is considered to be any person who electronically orders the Artwork or Artworks, fills in the required information and sends it successfully through the digital Registration Form, as a Registered User or as a Guest User, for which an order confirmation will be sent to the Customer's e-mail address.
1.6. About the Contract
The Contract enters into force and is binding from the moment the user accepts the offer of Josip Konta Art d.o.o. in one of the following ways:

1.7. Selling price
The selling price is expressed in the Croatian national currency, the Croatian kuna (HRK), including VAT. In the description of Art, for your easier comparison, the prices in US dollar (USD) and euro (EUR) are informatively shown, which are not binding for Josip Konta Art doo, since certain deviations are possible due to exchange rate differences in relation to the selling price expressed in Croatian Kuna (HRK).
1.8. Exchange rate fluctuations
Josip Konta Art d.o.o. is not responsible for any daily exchange rate differences. Josip Konta Art d.o.o. will invest maximum engagement to regularly update the course. The status of exchange rates can be checked at the location

1.9. Our right to change these Terms of Use
We instruct Visitors/Users/Customers to familiarize themselves with these Terms of Use before purchasing and to check them regularly in order to be aware of all rights and obligations.
Josip Konta Art d.o.o. reserves the right to change these Terms of Use at any time without prior notice and will not be liable for any possible consequences arising from such changes. These changes take effect by posting on the website www.josipkontaart.com.

1.10. Who is allowed to use our website
Use of the services of www.josipkontaart.com is approved exclusively for adults. The reason for this is the technical limitations of the device on which the photograph was taken, i.e. the technical limitations on which the photographs are viewed, for example, these may be software limitations, various calibrations of monitors of technical devices on which the contents of the Internet store are viewed, lighting during photography, reflection of the environment during photography and similar. For these reasons, minor deviations in color shades are possible.
1.12. Possibility of unintentional errors in the text
We are not responsible for possible unintentional errors in the description of the Artworks. There may be slight differences between the Artworks in reality in terms of dimensions and the same Artworks described on this site due to the use of a different approach to measuring the dimensions of the Artworks and or different calibrations of measuring instruments. These differences can be exceedingly small and do not affect the overall impression of the Artwork. All descriptions are checked regularly and in detail.
2. TERMS OF SALE
2.1. Concluding a sales Contract
These Terms of Use as well as individual terms of sale indicated with information on certain Artworks represent the offer of Josip Konta Art d.o.o. through the Internet store
www.josipkontaart.com for concluding the Contract, and the User as the Buyer by his registration, concluding the order or in any other way determined by these Terms of Use accepts it, whereby it is considered that the Contract between the Buyer and Josip Konta Art d.o.o. has been concluded, and according to the conditions of sale stated in these Terms of Use.
The subject and commercial purpose of the Contract is the purchase of the selected Artwork or Artworks through the Internet store
www.josipkontaart.com with payment of the appropriate fee, or the price of the product and/or service. The contract is concluded by means of remote communication (Contract concluded at a distance) through: communication via Internet store, e-mail, telephone with human mediation and/or without it.
The Contract enters into force and is binding from the moment the user accepts the offer of Josip Konta Art d.o.o. in one of the following ways:

Upon concluding the Contract, the user will be provided with:

2.2. Terms of registration as a Registered Customer
The registration option allows the storage of data that will be used when ordering for contact, delivery or for advertising information about Artworks and special offers. Also, registration later ensures easier and simpler execution of orders.
In the process of registration or creation of a user account, the User/Customer is obliged to choose the name or name under which they will provide services and choose a security password and provide a valid e-mail address. All information required to register or create an account must be true, and the use or use of other people's data is expressly prohibited.
The registration or account is created for one person only and it is not allowed to communicate registration or account information to third parties. The User/Customer is obliged to keep information about their security password and user account. The use of someone else's registration or account is not allowed.
For violating the provisions of the Terms of Use from this chapter, Josip Konta Art d.o.o. reserves the right, at its sole discretion, to terminate the registration or user account of the User/Customer, without obligation to compensate the user for any cost or damage.
2.3. Contract termination
The Customer may unilaterally terminate the Contract no later than 14 (fourteen) days from the date of concluding the Contract, without stating the reasons. That is, 14 (fourteen) days from the day when the Customer or a third party designated by the Customer, who is not a courier service, the Artwork that is the subject of the Contract, is handed over in possession.
After the period of 14 (fourteen) days from the day of concluding the Contract, i.e. from the day when the Artwork which is the subject of the Contract is handed over to the Customer, the Customer has no right to unilateral termination of the Contract.
If the subject of termination of the Contract is Artwork that is damaged after delivery to the Customer, i.e. after the handover by the courier service, and since the Customer is obliged to inspect the delivered Artwork during the handover, the Customer is not entitled to unilateral termination of the Contract.
2.4. Notice regarding termination of the Contract
In order for the Customer to be able to exercise the right to unilateral termination of the Contract, he must notify Josip Konta Art d.o.o. on its decision on unilateral termination of the Contract before the expiration of the term by an unambiguous statement sent by registered mail (to Josip Konta art studio, Dalmatinska ul. 7, 10000 Zagreb), or by e-mail to This email address is being protected from spambots. You need JavaScript enabled to view it., in which the Customer will state his name and last name, address, telephone number and e-mail address, and you may also use the above written Form for unilateral termination of the Contract.

2.5. Terms of return of funds to the Customer
In case of fulfillment of conditions for unilateral termination of the Contract, refunds will be made to the Customer in the amount received from him, not including delivery costs, without delay, within 14 (fourteen) days from the day when Josip Konta Art d.o.o., or
www.josipkontaart.com, receive the Customer's decision on unilateral termination of the Contract. The refund will be made in such a way that the Customer does not bear any costs in relation to the refund, other than the cost of transport. Refund Josip Konta Art d.o.o. will perform only after the Artwork is returned and inspected in what condition it is in view of the fulfillment of the conditions of the right to unilateral termination of the Contract.
Josip Konta Art d.o.o. do not bear any costs of fees by the Customer's bank and the like, which the Customer may have when returning the funds.
2.6. Address for return of Artwork
The Customer is obliged to deliver the Artwork to the address of the Artist; JOSIP KONTA art studio, Dalmatinska ul. 7, HR-10000 Zagreb, Croatia,
without delay, and in any case no later than 14 (fourteen) days from the day when according to Josip Konta Art d.o.o., or
www.josipkontaart.com, the Customer sent its decision to unilaterally terminate the Contract. All direct and indirect costs of returning the Artwork are borne by the Customer. Shipments sent by cash on delivery will not be picked up and it is considered that the Customer has not returned the Artwork.
2.7. Shipment return costs
We instruct the Customer that before accepting the offer and concluding the Contract with Josip Konta Art d.o.o. check the costs of sending the shipment in case of return due to termination of the Contract. All the necessary data related to the shipment (box dimensions and shipment weight) for the exact calculation of the cost of returning the shipment to the sender are available at

2.8. Responsibility for impairment
The Customer is responsible for any impairment of the Artwork resulting from the handling of the Artwork. In case of damage to the original packaging, the amount of the refund will be reduced by a percentage corresponding to the value of the original packaging. In that case, you will be notified.
2.9. Possibility of a lawsuit for business damage
We refer the Customer to the possibility of a lawsuit for business damage in case of missed sale of the Artwork type of sculptures, oil on canvas and pastel drawing to another buyer during the process of termination of the Contract since the Artwork is not in the possession of Josip Konta Art d.o.o. during the process of terminating the Contract.
2.10. Terms and procedure of purchase
The Customers are kindly instructed to become fully acquainted with all the characteristics of the Artwork before purchasing. Customers are free to request any additional information about the Artwork they are interested in, in order to eliminate any unknowns. Each Artwork can be physically viewed at the location of JOSIP KONTA art studio or at the location of the art exhibition where the Artwork is on display.

The main characteristics of the Artworks, conditions of use, prices, special benefits, methods of payment and methods of delivery relate to the Artworks on offer and are valid at the time of the order, i.e. the activation of the Contract. The above informations will be indicated with each Artwork.
2.11. Selling price
The price of the Artwork, which includes the amount of VAT, is visible in the shopping cart before concluding the order. All information on the purchase confirmation based on the electronic order will be delivered to the Customer's e-mail address specified in the registration/order procedure or in the purchase basket when entering data when concluding the order.
The selling price is expressed in the Croatian national currency, the Croatian kuna (HRK), including VAT. A calculator is available to convert the sales amount into the currencies of other countries, for your easier comparison. Pay attention to the default way of entering a numerical amount in the calculator. The sales prices thus obtained in the currencies of other countries are informative and not binding on Josip Konta Art d.o.o., as certain minor deviations are possible due to exchange rate differences in relation to the sales price expressed in Croatian kuna (HRK). Only the exchange rate of the Croatian National Bank is relevant.

2.12. Order confirmation notification
If the Customer does not receive the order confirmation notification, there is a possibility that he has entered his e-mail address incorrectly. We kindly ask the Customer to check the spam section.

2.13. Purchase without registration
It is possible to purchase without registration after the Customer has read and accepted this Terms of Use.
2.14. Data protection during purchase
Josip Konta Art d.o.o. undertakes to respect the anonymity and privacy of the Visitor/User/Customer of the

3. DELIVERY AND TERMS OF DELIVERY
3.1. Shipping costs
The costs of delivery to the address of the Customer shall be borne by Josip Konta Art d.o.o., within the deadlines in accordance with the conditions specified in these Terms of Use, unless otherwise indicated. Delivery time is the time frame within which Josip Konta Art d.o.o. ship the purchased Artwork to the Customer.
3.2. Artworks packaging
The ordered Artwork or Artworks are packaged in such a way that they cannot be damaged by the usual manipulation in international transport/delivery. We pack each of your ordered Artworks in wooden crates and additionally protect them with specialized transport packaging. You do not have to worry; your Artwork will arrive in a tidy/undamaged condition as soon as possible - this is our responsibility and our mission.
3.3. Shipping deadlines
The deadline for shipment of the purchased Artwork, in the entire territory of Croatia is 7 working days (Saturday and Sunday excluded)from the date of payment received, in accordance with the delivery deadlines of DHL Express and other delivery services. Delivery time of Artwork for places that are under a special delivery regime, the delivery time may be longer than 7 working days, in accordance with the delivery deadlines of DHL Express or other delivery services, of which we will inform the Customer.
The deadline for shipment of purchased Artwork worldwide is 10 working days (Saturday and Sunday excluded) from the date of payment received, in accordance with the delivery deadlines of DHL Express and other delivery services. The delivery time for places that are under a special delivery regime, the delivery time may be longer than 10 working days, in accordance with the delivery deadlines of DHL Express or other delivery services, of which we will inform the Customer.
In the event of a change in the delivery deadline or any other important circumstances for the execution of the order, the Customer will be notified immediately by our Customer Service.
3.4. Customs costs
Josip Konta Art d.o.o. does not bear the possible costs of customs cleared in other countries. Josip Konta Art d.o.o. has no obligation to anticipate such costs and therefore disclaims them entirely. The cost of customs clearance and any accompanying costs due to the administrative requirements of the country of destination shall be borne exclusively by the Customer. We instruct Customer to familiarize themselves with the amount of customs duties and possible additional costs when purchasing Artworks without delay in their country.
3.5. Shipment delay
Josip Konta Art d.o.o. is not responsible in case of shipment delay caused by emergencies or force majeure, such as pandemic, epidemic, earthquake, flood, fire, state of war, coup, political crisis, strike, protest or other emergencies that significantly disrupt the functioning of civilian society. In situations of force majeure, Josip Konta Art d.o.o. will, in agreement with the Customer, make every effort to deliver the Artwork to the Customer.
3.6. Place of dispatch of Artwork
The Artworks will be shipped to the Customer directly from the Artist's studio, i.e., the logistics service will pick up the Artworks directly from the location of the Artist's studio. The location of the Artist's studio is JOSIP KONTA art studio, Dalmatinska ul. 7, Zagreb, Croatia.
3.7. Artwork insurance
The Artworks are insured in transport up to the amount agreed with the logistics service, about which the Customer will be informed.
3.8. How to pick up shipment
The Customer is obliged to inspect the packaging of the shipment before collection. If the packaging of the shipment has visible serious damage/defects, we recommend that the Customer refuses to receive it, because there is a possibility that the Artwork within such packaging is damaged. By rejecting the receipt, the delivery service will fill in the Damage report and return the shipment to Josip Konta Art d.o.o., noting that the shipment contains a significant defect, i.e. damage, due to which the Customer refused to receive the shipment.
3.9. How are the delivery deadlines for Artworks determined?
Josip Konta Art d.o.o. strives to deliver the Artwork to the Customer in the shortest possible time, if possible, shorter than the deadline we have offered in this chapter Delivery and delivery conditions.
We strive to follow the rule that the Artwork is delivered to the Customer within 4 to 5 working days from the date of shipment.
In addition to the preparation and packaging of the Artwork, the deadline for dispatch of the Artwork includes the deadlines for obtaining the necessary supporting documentation for the purchased Artwork, which must be obtained from the Ministry of Culture of the Republic of Croatia (hereinafter: Ministry) for the country to which the Artwork will be delivered.
Considering that obtaining the documentation depends on the Ministry, in case of an extreme situation where the obtaining of the necessary documentation is delayed, and the cause of which is the Ministry, Josip Konta Art d.o.o. reserves the legal right to deliver the Artwork by transferring physical possession or control of the Artwork to the Customer, without undue delay, no later than 30 days from the conclusion of the Contract.
3.10. Picking up the Artwork in person at the Artist's Studio
Josip Konta Art d.o.o. will enable the Customer to personally pick up the Artwork in the Artist's studio, at the address JOSIP KONTA art studio, Dalmatinska ul. 7., Zagreb HR-10000, Croatia, in accordance with the previous agreement. The Customer must prove his identity through an ID card or passport before taking over the Artwork. The courier service that takes over the Artwork on behalf of the Customer must have a notarized limited power of attorney.
4. CUSTOMER COMPLAINTS
4.1. Contacts for complaint
Complaints regarding the lack of purchased Artwork and all other complaints can be made in writing by e-mail or regular mail:

4.2. Customer complaints resolution options
In case of a justified complaint, the Customer has the following options:

- termination of the Contract with refund of the amount paid. The cost of returning the Artwork and resending it to the Customershall be borne by Josip Konta Art d.o.o.
- replacement for the same Artwork after the defects have been removed. The cost of returning the Artwork and resending it to the Customer shall be borne by Josip Konta Art d.o.o.
- replacement for another Artwork in the same equivalent, i.e. with a surcharge or refund of part of the funds if necessary. The cost of returning the Artwork and resending it to the Customer shall be borne by Josip Konta Art d.o.o.
4.3. Terms of complaint
In case of damage and/or malfunction of the delivered Artwork, and before the return of the disputed Artwork as subsequent physical evidence, the Customer must send as many photos of the complained damage and/or malfunction as possible in the complaint report, in a minimum resolution of 1280 x 720 pixels (720p) to e-mail address This email address is being protected from spambots. If the Customer submits photos below the minimum resolution of 1280 x 720 pixels (720p) in the complaint report, we will not consider the complaint report complete, i.e. justified, and we will reject it. We kindly ask the customer for understanding because we need to have a detailed technical insight into reported complaint.
4.4. The cost of replacing Artwork
Josip Konta Art d.o.o. collects the complained, i.e. damaged, defective or incorrectly delivered Artwork at its own expense if it is determined that the complaint is justified and that the Customer has not affected the defect, damage or any other defect of the Artwork. In the event of a justified complaint within the deadlines set by the Civil Obligations Act of the Republic of Croatia, the entire cost of replacing the Artwork with a new or replacement, if agreed with the Customer, shall be borne entirely by Josip Konta Art d.o.o.
4.5. Appeal against resolution of the complaint

Upon the issuance of the decision, both parties, the Customer and Josip Konta Art d.o.o., receive the minutes. Such an official report of an independent body shall be deemed relevant and sufficient to complete the complaint procedure.
4.6. Warranty period
The warranty period in connection with the defect of the purchased Artwork lasts for two years from the date when the Customer received the Artwork. The warranty period is valid provided that the Customer maintains the Artworks in accordance with the instructions set out in these Terms of Use.

7. INSTRUCTIONS FOR MAINTENANCE OF ARTWORKS
The Artworks in our offer can be sculptures, oils on canvas and pastel drawings. In the text, the term Artwork includes all types of artworks that may be in our offer - sculptures, oils on canvas or pastel drawings, unless otherwise indicated, then the text will say Artwork type of sculpture, Artwork type oil on canvas or Artwork type pastel drawing.
7.1. Maintenance of bronze sculpture
7.1.1. In general
The sculptures in our offer are usually made in patinated bronze, unless otherwise indicated. Sculptures made in patinated bronze can be exhibited in the interior and exterior. Sculptures in patinated bronze require maintenance, especially if they are exposed to the weather. In this case, the bronze must be protected at least once a year with a wax to protect the patinated bronze, and the stone plinth should be protected with a stone protection agent that has a water-repellent function.
7.1.2. Bronze patina changes
Bronze patina can to some extent change its shades due to the action of external influences and due to the natural oxidation of bronze. Mild changes in the bronze patina are not considered damage and/or malfunction. If you expect that there should be no changes to the bronze patina, especially if you plan to place the sculpture in the exterior, please do not buy a sculpture made of patinated bronze.
7.1.3. Means for maintaining patinated bronze
Never use any chemicals, cleaning solutions, stain removers or any other unknown or previously untested substances to clean the surface of the sculpture. Avoid exposing the sculpture to the following chemicals, including but not limited to: grass and tree fertilizers, chlorine, pesticides, sprays and mists, window cleaners, ammonia, or other common household products. Untested chemicals will adversely affect the patina.
Look for proven products for cleaning and protecting patinated bronze on the market.
7.1.4. Hand tools for maintaining patinated bronze
NEVER use abrasive cleaning pads, steel wool or sandpaper on the sculpture. The use of such materials will damage the surface of the sculpture and require finishing and repair of the sculpture. Maintain sculptures with non-abrasive soft textile cloths, non-abrasive soft sponges or very soft brushes.
7.1.5. Bronze-steel joint
Do not place the bronze sculpture directly on a steel base. The merging of these two different metals, especially when wet, will eventually cause a chemical reaction called electrolysis (in which case the metals can decay). To avoid electrolysis, bronze sculptures can be placed on a steel base by placing a rubber, silicone or plastic pad between the two metals, ensuring that the metals do NOT join.
7.1.6. Cleaning and maintenance patinated bronze
Bird droppings should be washed immediately from the sculpture. If the sculpture looks dry or matte, coat the sculpture with sculpting wax. The method of applying the wax and the conditions for applying the wax (eg the temperature of the surface of the sculpture during waxing) should be in accordance with the instructions of the wax manufacturer for the protection of the sculptures.
7.1.7. Placing the sculpture in a humid environment
It is good practice to regularly maintain the sculpture with a clean non-abrasive soft textile cloth. In this way, the accumulation of dirt and smog and bird droppings from the sculpture is regularly removed, which will facilitate maintenance.
If you plan to place the bronze sculpture in a fountain, where the sculpture will be constantly sprayed with water, certain precautions must be taken. Your fountain should be equipped with the necessary filter. If your area has hard water, it is necessary to install filters that filter minerals and salts, so that the negative impact of water on the patinated bronze sculpture is as small as possible. Before placing a sculpture in such an environment, seek consultation with your landscape designer or planner. In such conditions, the sculpture will need to be coated with a protective wax much more often (we recommend every 2 months) to maintain the surface appearance. However, positions where the sculpture is constantly sprayed with water can still lead to a change in the color of the patina, which is considered normal for sculptures placed in humid environments.
Never spray the bronze sculpture with chlorinated water, or place the sculpture next to a swimming pool or jacuzzi. Chlorine is extremely corrosive and is likely to corrode metal and damage patina.
7.1.8. Environment with high salt content
Areas near the sea will have a more aggressive impact on the appearance of the patina of the bronze sculpture. A bronze sculpture placed in an area where the air is saturated with salt will cause much faster changes on the patina. The oxidation process can also cause more extreme changes on the patina that are generally considered beautiful. The buyer should be aware that in coastal areas these changes are most likely to occur.
7.1.9. Natural wear and aging
The natural course of bronze aging is inevitable, even when maintained, the patina will slowly change its appearance. This is highly desirable and is considered part of the joy of owning a fine bronze piece. Although bronze is very durable and will last for centuries, it must be accepted that patina will change its appearance over time.
7.2 Maintenance of oil on canvas and pastel drawings

Hang the painting in a place where it is not exposed to extreme temperatures and humidity. Do not hang the painting near windows, fireplaces, heaters, radiators or place it in rooms with a lot of moisture.
For heavier paintings, we recommend using two painting hanging hooks to provide enough support and balance. The painting should be high enough for people to see it, but not too high so as not to burden the viewer’s neck. We recommend that the center of gravity of the painting be placed 150 cm from the floor. If the painting is hung above a sofa or other seating area, the painting should be placed above the head height of the person sitting.

Use a soft brush to dust the surface of the painting to prevent dust from accumulating. For painting protected by maintenance glass, use a soft textile cloth.
